Platform Terms

These Platform Terms apply to guests and other end users who use Tilvo-powered ordering, account, loyalty, messaging, reservation, catering, gift card, website, or mobile app experiences.
1. Acceptance
By accessing or using a Tilvo-powered ordering website, restaurant app, loyalty account, reservation flow, catering flow, gift card feature, Voice AI agent, SMS flow, or related customer experience (the "Platform"), you agree to these Platform Terms and any restaurant-specific terms posted by the applicable Merchant.
2. Tilvo Is a Technology Provider
Tilvo is not a restaurant, food preparation entity, delivery company, or retailer of restaurant products. Restaurants and other Merchants operate independently and are responsible for food preparation, ingredients, allergen handling, menu claims, pricing, taxes, fulfillment, quality, refunds, gift cards, promotions, and compliance with laws that apply to their business.
3. Eligibility and Accounts
You must be able to form a binding contract and must be at least 18 to use the Platform. You are responsible for accurate account information, keeping credentials secure, and all activity under your account.
4. Orders, Delivery, and Availability
Orders are subject to Merchant acceptance, item availability, delivery area limits, store hours, capacity, weather, safety, fraud screening, and payment authorization. Estimated pickup and delivery times are estimates. Delivery may be performed by a Merchant, a third-party delivery provider, or another logistics partner.
5. Alcohol and Age-Restricted Items
If a Merchant offers alcohol or other age-restricted items, you represent that you meet all legal requirements. Pickup or delivery may require valid government identification and may be refused if legally required or if the recipient appears intoxicated or otherwise ineligible.
6. Payments, Tips, Fees, Refunds, and Chargebacks
You authorize charges for orders, taxes, delivery fees, service fees, tips, subscriptions, or other disclosed amounts. Payment processing is provided by third-party processors. Refunds and credits are generally determined by the applicable Merchant unless required by law.
7. Messaging and Communications
If you opt in to SMS or other communications, message frequency may vary and carrier rates may apply. SMS, MMS, voice, and phone number services may be delivered through communications providers such as Telnyx. Reply STOP to unsubscribe from SMS and HELP for help. Transactional service messages may continue where permitted. Calls may be recorded or transcribed where enabled and where legally permitted.
8. Acceptable Use
- Do not use the Platform for unlawful, fraudulent, abusive, deceptive, or harmful activity.
- Do not interfere with security, availability, rate limits, authentication, or payment systems.
- Do not scrape, copy, reverse engineer, or misuse Platform data except as legally permitted.
- Do not abuse promotions, submit false information, harass others, or infringe third-party rights.
9. Intellectual Property and User Content
Tilvo and its licensors retain ownership of the Platform. Merchants retain ownership of their restaurant marks and content. If you submit reviews, feedback, photos, messages, or other content, you grant Tilvo and the applicable Merchant permission to use it to operate, improve, support, and promote the Platform and Merchant services, subject to applicable law.
10. Third-Party Services
The Platform may rely on third-party payment, POS, authentication, delivery, mapping, messaging, telecom, analytics, app-store, and hosting services, including Telnyx for certain voice, SMS/MMS, SIP trunking, phone number, carrier-registration, and messaging functions. Those services may be subject to additional terms and privacy notices.
11. Disclaimers and Limitation of Liability
The Platform is provided "as is" and "as available." To the fullest extent permitted by law, Tilvo disclaims implied warranties and is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost data, order issues, food quality, Merchant conduct, delivery delays, or third-party service failures.
12. Suspension, Changes, and Contact
We may suspend or limit access for security, fraud, abuse, legal, or operational reasons. We may update these terms by posting a revised version. Questions may be sent to legal@tilvo.ai.
